Terms of Service

These terms (the “Terms”) apply when you visit incommon.ai (the “Site”), contact us through it, or otherwise deal with InCommon HQ Inc (“InCommon,” “we,” “us,” “our”). By using the Site you agree to them. If you do not agree, please do not use the Site.
Who we are
InCommon HQ Inc, 586 Undercliff Avenue, Edgewater, NJ 07020. We provide recruitment and talent services, and related employment and operations support. Questions about these Terms can go to hello@incommon.ai.
These Terms are not a services agreement
The Site is marketing and information. Nothing on it is an offer to provide services, a quote, or a guarantee of any hiring outcome. If you engage us, that engagement is governed by a separate written agreement signed by both parties — covering scope, fees, replacement and refund terms, exclusivity, data handling, and everything else specific to the work.
Where these Terms and a signed engagement agreement disagree, the signed agreement controls for that engagement.
Using the Site
You may use the Site for your own business or personal purposes. You agree not to:
- Scrape, crawl, or harvest content, candidate information, or contact details, whether manually or by automated means, except for standard search-engine indexing.
- Copy, republish, or resell any part of the Site or its content.
- Attempt to gain unauthorised access to the Site, its systems, or any data not intended for you.
- Interfere with the Site’s operation, security, or availability, or use it to distribute malware or unlawful material.
- Use the Site or anything obtained from it to train a machine-learning model without our prior written permission.
What you send us
If you contact us — through a form, by email, or otherwise — you confirm the information you provide is accurate and that you are entitled to share it. Where you send us details about another person, such as a candidate or colleague, you confirm you have the right to do so.
You keep ownership of what you send. You grant us permission to use it for the purpose you sent it and to run our business, in line with our Privacy & Cookie Policy. Please do not send confidential material through the Site before an agreement is in place; use it only to start a conversation.
If you send us ideas, suggestions, or feedback about our services, we may use them freely and without obligation to you.
Candidates
If you share your details with us as a candidate, we use them to consider you for roles and to contact you about opportunities. We do not charge candidates fees. We handle candidate information under our Privacy & Cookie Policy, and you can ask us to update or delete your details at any time by writing to hello@incommon.ai.
Introducing a candidate to a client is never a guarantee of an interview, an offer, or employment. Hiring decisions belong to the employer.
No guarantee of outcome
We describe our methods, our systems, and past results honestly, but hiring depends on many things outside our control — market conditions, candidate decisions, and your own process among them. Nothing on the Site is a promise of a particular result, timeline, or placement. Case studies, testimonials, and figures describe specific past engagements and are not a prediction of what will happen in yours.
Our content
The Site, its text, design, graphics, and the InCommon name and marks are owned by us or used with permission, and are protected by intellectual property law. You may quote short extracts with attribution and a link. Anything more requires our written permission.
Third-party links and tools
The Site links to other websites and uses third-party tools for analytics, forms, and scheduling. We do not control those services and are not responsible for their content, availability, or practices. Their own terms and privacy policies apply to your use of them.
Availability
We aim to keep the Site available and current, but we provide it “as is” and “as available.” We may change, suspend, or withdraw any part of it at any time without notice. To the extent the law allows, we exclude implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement.
Liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or lost business opportunity, arising out of your use of the Site.
Our total liability arising out of or relating to the Site is limited to one hundred US dollars (USD 100). Liability arising from a signed engagement is governed by that agreement instead. Nothing here limits liability that cannot be limited by law, including for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.
Indemnity
You agree to indemnify us against claims, losses, and reasonable costs arising from your misuse of the Site, your breach of these Terms, or your infringement of another party’s rights.
Governing law
These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-laws rules. The state and federal courts located in New Jersey have exclusive jurisdiction over any dispute arising from them, and you consent to that jurisdiction.
Changes to these Terms
We may update these Terms from time to time. The version published here is the one that applies, and the date at the top shows when it last changed. Material changes will be reflected in that date; continuing to use the Site after a change means you accept the updated Terms.
